Holding the Makers of Truvada Responsible

Groups Affected by the Truvada Lawsuit

Gilead Sciences Inc. created an ambitious prophylactic called Truvada that helps to both reduce the risk of contracting HIV and also helps those already infected with the virus to effectively manage. While at first glance this appears to be a truly remarkable medication, the unfortunate truth is that the manufacturers of Truvada hid information about the negative side effects caused by the drug – and also withheld a safer alternative.

Now, users from all backgrounds, ethnicities, age groups, and sexual orientations are developing severe kidney and bone complications as a result of using Truvada. These victims do NOT deserve to be harmed by a medication that was meant to protect their health.

Do you, or someone you love, take Truvada to manage HIV? Have you developed kidney or bone-related complications? Contact the Truvada lawsuit attorneys of The Law Offices of A. What is dangerous about Truvada?

At a glance, Truvada may seem like a miracle drug. It is made from a combination of emtricitabine (FTC) and tenofovir disoproxil fumarate (TDF), critical components that reduce the activity of reverse transcriptase, which is an enzyme that aids in the replication of the virus.

The downside to this, however, is that TDF plays a detrimental role in the development of numerous complications in the human body. To make matters worse, Gilead knew about these side effects but failed to warn users and physicians of these issues. The company even had a safer alternative that uses tenofovir alafenamide fumarate (TAF), a component that does not cause the same type of health complications as TDF.

Individuals from all walks of life that took the medication in good faith are now developing severe side effects and are turning to defective pharmaceutical lawyers to help them secure justice and recovery for the injuries they have sustained.

If you have taken Truvada and have begun to suffer from bone health-related complications or other issues, The Law Offices of A. Craig Eiland, PC wants to help you. The Faces Behind the Truvada Lawsuit

HIV affects a whole spectrum of individuals, many of whom are in loving relationships. As a response, over 136,000 individuals are taking Truvada to help them reduce the risk of developing the condition or as a means to manage it.

The following groups are at a higher risk of developing HIV and are generally most affected by it. As a result, the following groups may also be taking Truvada at a higher rate. If you or someone you know falls into any of these groups, are taking Truvada, and are suffering from severe complications as a result, seek out medical attention immediately.

The faces behind Truvada lawsuits include:

Gay and Bisexual Men

According to the organization NIDA, gay and bisexual men are the largest population affected by HIV in the United States. Men who have sex with men account for 2 percent of the total U.S. population, yet two-thirds of all new infections occurred within this demographic in 2009.

Truvada and the LGBTQ Community

Ethnic Minorities

This community as a whole is the largest that suffer from new HIV infections. Sadly, African-Americans make up the highest portion of ethnic minorities to contract the virus. In addition, African-American men that have sex with other men are at a higher risk; two-thirds of gay or bisexual HIV infections occurred in ethnic minorities.

The Hispanic community also showed increased numbers as well; one in five new HIV infections were attributable to this community in 2009. This indicates a rate that is three times higher than the white community.

Injection Drug Users

Unfortunately, those that suffer from addiction also put themselves at risk of contracting HIV. One out of 10 individuals will contract the disease because of sharing a needle with another individual who already has the virus. The Centers for Disease Prevention and Control states that HIV can survive on a used needle for up to 42 days, depending on the temperature and other factors.

According to NIDA, these numbers have dropped drastically since the 90s, where 23 percent of new HIV infections occurred during 1994 through 2000. In 2010, this number fell to 8 percent.

Heterosexual women who have had contact with an HIV positive partner accounted for over ¼ of all new infections in 2010. This number was more prevalent within ethnic minority communities.

Injection drug abuse also plays a major factor in women contracting the virus, accounting for 14 percent of HIV diagnoses. Massachusetts Department of Public Health stated that 40 percent of white women that have the virus contracted it from injection drug abuse.

Finally, whether it be from sexual or physical abuse experienced when they were children, adolescents, or adults, trauma is another big factor that plays a role in women contracting the virus.

Couples with a Partner Who Has HIV

Individuals in the Criminal Justice System

Individuals in the criminal justice system also suffer from high rates of HIV infection. It is estimated that the HIV population in the criminal justice system is 2 to 5 times larger than in other communities. An estimated 1 in 7 individuals that are HIV positive go through the prison system each year.

The Hazardous Side Effects of Truvada

Regardless of your background and ethnicity, Gilead Sciences Inc. took advantage of your trust and gave you a defective product.

Recently, it was found that TDF component found in Truvada may cause complications in the body’s process to build and strengthen bones. Normally, old bone is broken down in a process known as resorption while new bone is added in a process call formation.

This process is sped up by the TDF, so much so that the body cannot keep up in creating new bone. Essentially, the body is losing more bone than it can regenerate.

This decrease in bone mineral density leaves bones brittle and easily breakable. Over time, this loss of bone can contribute to:

  • Discomfort in extremities
  • Bone deterioration or osteoporosis
  • Bone loss or osteopenia
  • Tooth decay and loss
  • Bone fractures

These TDF-based drugs don’t just negatively affect bones, however. Kidneys get rid of excess calcium in the body, and all of that old calcium that is rapidly lost can build up and cause:

  • Chronic kidney disease
  • Declining kidney function/decreased urination
  • Acute kidney injury
  • Acute renal failure
  • Fanconi syndrome
  • Kidney failure

Lastly, lactic acidosis can develop in individuals taking Truvada. Lactic acidosis causes a pH imbalance in your system, making the body more acidic. This can cause:

  • Confusion
  • Headaches
  • Decreased appetite
  • Rapid heart rate
  • Jaundice
  • Extreme fatigue or exhaustion
  • Body weakness
  • Overall feelings of discomfort
  • Muscle cramps and pain
  • Abdominal pain or discomfort
  • Diarrhea
  • Breathing troubles

If you are taking Truvada to manage your HIV or to limit your risk of developing it, and have been affected by any of the previously mentioned side effects, it is essential that you seek out medical attention immediately.

What You Should Do If You Sustain Injury Due to Using Truvada

If you have sustained an injury or developed severe complications to your bones and/or kidneys, you need to get medical attention as soon as possible. Having a doctor diagnose the problem is essential to your health and any documentation they provide you will prove to be valuable evidence should you file a Truvada lawsuit.

Next, you need to secure strong legal representation. Your Truvada lawyer will help to determine the party liable for your injuries. In this particular case, Gilead Sciences Inc. allegedly withheld safer alternatives and side effect information, putting communities across the world at risk of developing severe complications.

To determine liability in a defective pharmaceutical claim, your lawyer must prove that your particular circumstance was the result of one of the following:

  • Strict Liability – A claim that focuses on the defective product. Experienced Truvada side effects attorneys have to prove that the product was defective by design, in the manufacturing process, or in the marketing process, making it unreasonably dangerous and causing injury to the person using Truvada.
  • Negligence – A claim that explores if the company, manufacturer, or marketer provided reasonable care to ensure the product was safe.
  • Breach of Warranty – A claim that focuses on a written or implied warranty. Under this kind of product liability claim, your lawyer will investigate whether the product acted as intended in accordance with the warranty or broke it and caused you harm.

Once we have determined liability and filed your claim, we will continue to work diligently to help secure the financial recovery you need to begin the healing process.

Our Truvada lawsuit attorneys will work diligently to help recover damages for but not limited to:

  • Medical bills (past and present)
  • Lost wages and future earnings
  • Pain and suffering
  • Loss of quality of life
  • Loss of consortium
  • Wrongful death expenses

Gilead must answer for the pain and suffering they have caused.
